SMARTERNUTHUB
REFUND, CANCELLATION & COMMITMENT POLICY
Effective Date: November 30, 2025 | Applicable Worldwide
IMPORTANT: Please read this Policy in full before purchasing or subscribing. By completing any purchase, activating a free trial, downloading any Digital Product, or subscribing to any Smarternuthub service, you confirm that you have read, understood, and irrevocably agreed to be bound by this Policy in its entirety. This Policy applies worldwide and forms part of the Smarternuthub Terms of Service.
SECTION 1: DEFINITIONS & PRICING TERMS
The following defined terms apply throughout this Policy. All current pricing is published on the Smarternuthub website pricing page at smarternuthub.com (the "Pricing Page"), which is publicly accessible at all times. The price applicable to your purchase is the price displayed on the Pricing Page at the time you complete your transaction. Smarternuthub reserves the right to update prices from time to time in accordance with Section 9.4.
"Annual Monthly Rate" the discounted monthly fee applicable to the Annual Commitment Plan, as published on the Pricing Page at the time of your subscription activation.
"App Subscription Rate" the monthly fee for the standalone Nutrition Tracking App subscription, as published on the Pricing Page at the time of your App subscription activation.
"Commitment Period Total" the total financial obligation under the Annual Commitment Plan, calculated by multiplying the Annual Monthly Rate by twelve (12). Your specific Commitment Period Total is confirmed in your purchase confirmation email.
"Digital Products" all downloadable and accessible content produced by Smarternuthub, including the Membership, the App, all eBooks, the Supplement Guide, and any other digital or educational material.
"eBook Rate" the one-time purchase price for the Macro & Micro Nutrient Nutrition eBook, as published on the Pricing Page at the time of purchase.
"Membership" the Smarternuthub monthly subscription product providing access to Membership Content, Clinic Hours Content, recipe content, the Community, and the Nutrition Tracking App.
"Pricing Page" the current pricing page published on the Smarternuthub website at smarternuthub.com, which is the authoritative and always-current record of all Smarternuthub subscription fees and product prices.
"Standard Monthly Rate" the month-to-month Membership subscription fee, as published on the Pricing Page at the time of your subscription activation or most recent renewal, as applicable.
"Your Confirmed Rate" the specific fee applicable to your subscription or purchase, as confirmed in the purchase confirmation email sent to your registered email address at the time of transaction. In the event of any discrepancy between the Pricing Page and your purchase confirmation email, Your Confirmed Rate governs that specific transaction.
How to check your rate: Your current subscription rate is displayed in your account settings and was confirmed in the purchase confirmation email sent to you at activation. If you are unsure of your applicable rate, contact hello@smarternuthub.com before purchasing or renewing.
SECTION 2: ALL SALES ARE FINAL — ZERO REFUND POLICY
2.1 No Refunds Under Any Circumstances
Smarternuthub operates exclusively in Digital Products. Due to the irrevocable nature of digital access — which cannot be returned, un-downloaded, or un-accessed — ALL SALES ARE FINAL. No refunds, credits, exchanges, or pro-rata adjustments will be issued under any circumstances, including but not limited to:
Change of mind after purchase or subscription activation
Dissatisfaction with results, content format, coaching style, or any aspect of the product
Failure to use, access, log in to, or engage with any Digital Product after purchase or activation
A change in personal circumstances after purchase, including illness, financial hardship, or relocation
Inability to access content due to your own internet connection, device, browser, or technical limitations
Failure to cancel a free trial or subscription before the relevant billing deadline
Failure to review the Pricing Page, product descriptions, Terms of Service, or this Policy before purchase
Any other reason not expressly required by the mandatory laws of your jurisdiction
2.2 Immediate Delivery and Full Performance
2.2.1 By completing any purchase or activating any subscription or free trial, you expressly acknowledge and agree that:
(a) Smarternuthub grants access to Digital Products immediately upon receipt of payment or activation;
(b) delivery is complete and fully performed at the moment access is granted; and
(c) Smarternuthub has fulfilled its entire contractual obligation upon providing such access.
2.2.2 You irrevocably waive any right to withdraw from or rescind any transaction on the basis of change of mind, to the fullest extent permitted by the laws of your jurisdiction.
2.3 Universal Scope — All Products and Services
This zero-refund policy applies to every product and service offered by Smarternuthub, whether currently available or released at any future date, including:
Month-to-month Membership subscriptions at the Standard Monthly Rate
Annual Commitment Membership at the Annual Monthly Rate (12-month binding commitment)
Nutrition Tracking App subscriptions at the App Subscription Rate (following the 7-day free trial)
Paid eBooks at the eBook Rate, including the Macro & Micro Nutrient Nutrition eBook
All other one-time digital purchases, guides, templates, calculators, meal planners, and printables at the price published on the Pricing Page at the time of purchase
Any bundle, package, promotional offer, upsell, add-on, or limited-time product
No separate or additional refund right attaches to any product unless expressly set out in a specific written instrument signed by an authorised officer of Smarternuthub.
SECTION 3: PRODUCT-SPECIFIC CANCELLATION TERMS
3.1 Month-to-Month Membership — Standard Monthly Rate
3.1.1 If you hold a month-to-month Membership, you may cancel at any time through your account settings or by written notice to hello@smarternuthub.com. The Standard Monthly Rate applicable to your subscription is Your Confirmed Rate as set out in your purchase confirmation email.
3.1.2 IMMEDIATE TERMINATION OF ACCESS: Upon cancellation, your access to all Membership Content, Clinic Hours Content, recipe content, the Community, and the App (where included in the Membership) terminates immediately at the point of cancellation. No continued access is provided beyond the cancellation point, regardless of how recently your Membership fee was charged.
3.1.3 No Proration or Partial Refund: Membership fees are non-prorated under all circumstances. No refund is issued for any portion of a billing cycle remaining at the time of cancellation.
3.1.4 Auto-Renewal: Your Membership automatically renews on each Billing Date at Your Confirmed Rate, subject to any price variation notified under Section 9.4. You bear sole responsibility for cancelling before the next Billing Date if you do not wish to be charged.
3.1.5 Cancellation Confirmation: Smarternuthub will provide written email confirmation of cancellation. If not received, your cancellation may not have been processed and you remain liable for all subsequent charges. Contact hello@smarternuthub.com immediately if confirmation is not received.
3.2 Annual Commitment Membership — Annual Monthly Rate (12-Month Binding Contract)
BINDING FINANCIAL COMMITMENT — READ THIS SECTION IN FULL BEFORE SELECTING THIS PLAN. The Annual Commitment Plan is a fixed-term contract at the Annual Monthly Rate published on the Pricing Page at the time of your activation, payable monthly for twelve (12) consecutive months totalling the Commitment Period Total. This is not a month-to-month subscription and cannot be cancelled early under any circumstances.
3.2.1 Nature of the Commitment: The Annual Commitment Plan is offered at the Annual Monthly Rate — a discounted rate relative to the Standard Monthly Rate — in consideration of your binding commitment to maintain an active subscription for twelve (12) consecutive months (the "Commitment Period"). Smarternuthub would not offer the Annual Monthly Rate in the absence of this 12-month obligation.
3.2.2 Billing Authorisation: By selecting the Annual Commitment Plan, you irrevocably authorise Smarternuthub to charge the Annual Monthly Rate to your nominated payment method on the same calendar date each month for the full Commitment Period, totalling twelve (12) charges amounting to the Commitment Period Total. This authorisation is irrevocable for the Commitment Period. Your Annual Monthly Rate and Commitment Period Total are confirmed in your purchase confirmation email.
3.2.3 ABSOLUTE PROHIBITION ON EARLY EXIT: You may not cancel, suspend, pause, or terminate the Annual Commitment Plan before the end of the Commitment Period under any circumstances. Attempting to do so — including by cancelling your payment method, reversing a transaction, or initiating a chargeback — does not relieve you of your financial obligations. If you attempt to exit early:
(a) You remain legally liable for all remaining monthly payments at the Annual Monthly Rate through the end of the Commitment Period, regardless of whether you access or use the Membership.
(b) Smarternuthub may immediately suspend or terminate access to all Membership Content upon any missed, reversed, or disputed payment.
(c) Smarternuthub may refer any outstanding balance to a third-party debt recovery agency and commence civil proceedings to recover all outstanding amounts together with interest, agency fees, and legal costs on a solicitor-client basis.
(d) Any chargeback during the Commitment Period will be treated as a material breach and potentially fraudulent conduct (see Section 7).
(e) Smarternuthub may report any default to credit reporting bodies and fraud prevention registries.
3.2.4 IMMEDIATE TERMINATION ON PAYMENT FAILURE: If any payment within the Commitment Period is missed, declined, reversed, or disputed, Smarternuthub may immediately terminate access to all Membership Content, the Community, and the App without notice. Termination does not relieve you of the obligation to pay all remaining instalments of the Commitment Period Total.
3.2.5 Post-Commitment Auto-Renewal: Upon expiry of the Commitment Period, your Membership automatically converts to a month-to-month subscription at the then-current Standard Monthly Rate published on the Pricing Page, unless you provide written cancellation notice to hello@smarternuthub.com at least seven (7) days before the next Billing Date.
3.2.6 Acknowledgement of Annual Commitment: By completing purchase of the Annual Commitment Plan, you confirm that you:
(a) have read and fully understood the nature, duration, and financial consequences of the Commitment Period;
(b) have reviewed the Annual Monthly Rate and Commitment Period Total on the Pricing Page and in your purchase confirmation email, and agree those figures govern your obligation;
(c) have voluntarily selected this plan in exchange for the discounted Annual Monthly Rate;
(d) acknowledge that Smarternuthub would not provide access at the Annual Monthly Rate without this binding obligation;
(e) accept full financial responsibility for all 12 monthly payments at the Annual Monthly Rate regardless of usage; and
(f) understand that no hardship, change of circumstances, dissatisfaction, or price movement constitutes grounds for early exit.
3.3 Nutrition Tracking App Subscription — App Subscription Rate
3.3.1 The Nutrition Tracking App is available on a standalone monthly subscription at the App Subscription Rate published on the Pricing Page at the time of activation. A 7-day free trial is available to new subscribers on the terms set out in the Smarternuthub Terms of Service.
3.3.2 AUTOMATIC CHARGE ON FREE TRIAL EXPIRY: By activating the free trial, you irrevocably authorise Smarternuthub to automatically charge the App Subscription Rate upon expiry of the 7-day trial, unless you cancel at least twenty-four (24) hours before expiry. No reminder will be sent. It is your sole responsibility to track your trial expiry.
3.3.3 24-HOUR CANCELLATION DEADLINE: To avoid being charged for the next billing cycle, cancellation must be completed at least twenty-four (24) hours before your Billing Date. Cancellations within twenty-four (24) hours will not prevent that charge, which is non-refundable.
3.3.4 Access on Cancellation: Upon cancellation of a standalone App subscription, access continues until the end of the current paid billing cycle, then terminates. No partial refund is issued for unused days.
3.3.5 Where App access is included in a Membership, cancellation of the Membership immediately terminates App access under Sections 3.1.2 or 3.2.4, as applicable.
3.3.6 All App Subscription fees are non-prorated and non-refundable regardless of the reason for cancellation.
3.4 Paid eBook — eBook Rate
3.4.1 The Macro & Micro Nutrient Nutrition eBook is a one-time purchase at the eBook Rate published on the Pricing Page at the time of purchase. Access is granted immediately upon payment.
3.4.2 STRICTLY NO REFUNDS: All eBook purchases are final. No refund, credit, exchange, or download reversal is available once purchase is complete — regardless of whether you have downloaded, opened, or read the eBook.
3.4.3 Smarternuthub does not warrant that the eBook will meet individual expectations or remain current following purchase. The eBook is education content only, subject to Section 2 of the Smarternuthub Terms of Service.
3.5 Free Digital Products — GLP-1 Nutrition eBook & Supplement Guide
3.5.1 The GLP-1 Nutrition eBook and Supplement Guide are provided free of charge. No financial transaction is associated with these products and no refund, credit, or chargeback is applicable.
3.5.2 By downloading any free Digital Product, you agree to this Policy and the Smarternuthub Terms of Service in their entirety.
3.5.3 Smarternuthub reserves the right to modify, withdraw, or cease distribution of any free Digital Product at any time without notice and without liability.
SECTION 4: INTERNATIONAL CONSUMER RIGHTS
4.1 Smarternuthub operates a worldwide business and acknowledges that consumers in certain jurisdictions hold statutory rights that cannot be excluded or modified by contract. Nothing in this Policy overrides those non-excludable rights.
4.2 Where mandatory consumer protection laws in your jurisdiction confer rights that cannot be contractually waived, Smarternuthub will comply to the minimum extent legally necessary, while expressly reserving all rights available to it under applicable law.
4.3 You are responsible for understanding the consumer rights available to you in your jurisdiction before purchasing.
EU/UK Consumers: If resident in the EU or UK, you may have a statutory right of withdrawal from certain distance contracts. However, under Article 16(m) of the Consumer Rights Directive (EU) 2011/83/EU and its UK equivalent, this right does not apply to digital content where performance has begun with your prior express consent and acknowledgement that you lose your withdrawal right. By completing any purchase and accessing any Digital Product, you expressly consent to immediate performance and acknowledge the loss of your withdrawal right. Do not complete your purchase if you do not consent.
Australian Consumers: Your rights under the Australian Consumer Law (ACL) are addressed in Section 5. Nothing in this Policy excludes any ACL right that cannot be lawfully excluded.
US Consumers: Consumer protection laws vary by state. Where specific cancellation rights or cooling-off periods apply to digital subscriptions in your state, Smarternuthub will comply to the minimum extent required by law. The class action waiver and arbitration clause in the Smarternuthub Terms of Service apply to the maximum extent permitted.
SECTION 5: AUSTRALIAN CONSUMER LAW NOTICE
5.1 Statutory Guarantees
5.1.1 Nothing in this Policy limits, excludes, or modifies any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). To the maximum extent permitted by law, all implied conditions and warranties beyond those expressly set out here are excluded.
5.1.2 Where the ACL implies a guarantee that cannot be excluded, Smarternuthub's liability is limited to resupply of the relevant service or the cost of resupply, per section 64A of the ACL.
5.2 Major Failure — Narrowly Defined
5.2.1 You acknowledge that none of the following constitute a major failure under the ACL:
(a) Dissatisfaction with coaching style, tone, presentation format, or personality of the content creator.
(b) Failure to achieve any specific weight loss, health, metabolic, or personal outcome.
(c) A post-purchase determination that the product does not suit your lifestyle, preferences, or goals.
(d) Failure to use, open, or engage with any Digital Product after access is granted.
(e) Medical, physical, or personal conditions affecting your ability to participate or benefit.
(f) Changes to Membership Content or App features made in the ordinary course of operating an evolving digital content business.
(g) Any circumstance within your own control affecting your experience, access, or results.
5.3 Reporting a Genuine ACL Failure
5.3.1 If you believe in good faith that you have experienced a genuine major failure under the ACL, notify Smarternuthub in writing at hello@smarternuthub.com within fourteen (14) days of the alleged failure. Late notifications may not be considered.
5.3.2 Smarternuthub reserves the right to investigate, request supporting evidence, and determine whether a statutory remedy is warranted before providing any resolution.
SECTION 6: OUTSTANDING BALANCES & DEBT RECOVERY
6.1 Any amount due to Smarternuthub — including outstanding Annual Commitment Plan instalments at the Annual Monthly Rate, unpaid App Subscription fees, and amounts recoverable following a fraudulent chargeback — constitutes a debt recoverable by all lawful means.
6.2 Smarternuthub reserves the right to:
(a) immediately suspend or terminate access to all Smarternuthub products upon payment default, without notice and without reducing your financial obligations;
(b) charge interest on outstanding balances at ten percent (10%) per annum, calculated daily from the due date until paid in full;
(c) refer outstanding balances to a third-party debt recovery agency, with all associated costs added to your liability;
(d) commence civil proceedings to recover all amounts together with legal costs on a solicitor-client basis; and
(e) report any default to credit reporting bodies and fraud prevention registries, to the extent permitted by applicable law.
6.3 All recovery costs incurred by Smarternuthub — including legal fees, agency fees, chargeback fees, and court costs — are your liability and may be added to the outstanding debt.
SECTION 7: CHARGEBACK & PAYMENT DISPUTE POLICY
7.1 Zero Tolerance for Fraudulent Chargebacks
7.1.1 Smarternuthub enforces a strict Zero Tolerance Policy for fraudulent or bad-faith chargebacks ("friendly fraud"). A chargeback is fraudulent where it is initiated by a person who: (a) knowingly received access to any Digital Product; and (b) has no valid legal or contractual basis for the dispute.
7.1.2 Initiating a chargeback without valid basis constitutes a material breach of this Policy and the Smarternuthub Terms of Service, and may constitute fraud under applicable civil and criminal law.
7.2 Evidence Smarternuthub Will Provide
7.2.1 In response to any chargeback, dispute, or complaint, Smarternuthub will provide to the relevant payment processor, bank, and/or authority:
(a) IP address, device fingerprint, and geolocation data recorded at purchase, activation, and login;
(b) timestamped login records, content access logs, App session data, and platform interaction history;
(c) the full text of this Policy and the Terms of Service, including your acceptance date, time, and method, and the price confirmed at transaction;
(d) all email communications including purchase confirmations displaying Your Confirmed Rate and welcome emails;
(e) for Annual Commitment Plan members: records of acceptance of the 12-month obligation at the Annual Monthly Rate and Commitment Period Total, including the acknowledgement at Section 3.2.6; and
(f) any other evidence of access, engagement, or use of the relevant product.
7.3 Consequences of a Fraudulent Chargeback
7.3.1 Where a chargeback is found to have been initiated without valid basis, Smarternuthub reserves the right to:
(a) permanently terminate access to all Smarternuthub products and services with no right of reinstatement;
(b) pursue civil recovery of the disputed amount, all processor chargeback fees, administrative costs, and legal fees on a solicitor-client basis;
(c) report the conduct to credit reporting bodies, fraud prevention registries, consumer protection agencies, and law enforcement; and
(d) for Annual Commitment Plan members: pursue recovery of all remaining Commitment Period instalments at the Annual Monthly Rate in addition to all other costs.
7.3.2 Smarternuthub treats all fraudulent chargeback attempts with the utmost seriousness and will pursue recovery and reporting in every case where valid legal recourse exists.
SECTION 8: THIRD-PARTY PRODUCTS & EXTERNAL LINKS
8.1 Smarternuthub is not a party to any transaction you enter into with a third-party vendor — including supplement companies, equipment retailers, or any product referenced in Smarternuthub content, including the Supplement Guide — and accepts no responsibility for the quality, safety, efficacy, or refund obligations of any third-party product.
8.2 Where Smarternuthub has an affiliate relationship with a third-party vendor, this will be disclosed. An affiliate relationship does not create any warranty and does not entitle you to seek a refund from Smarternuthub for a third-party purchase.
8.3 Irrevocable Release: You irrevocably release Smarternuthub and its officers, employees, contractors, and agents from all claims arising from third-party products or services. All disputes must be directed to the relevant vendor.
8.4 External Links: Links to external websites or resources within any Smarternuthub content are for convenience only. Smarternuthub does not endorse or accept responsibility for any external resource. Access is entirely at your own risk.
SECTION 9: GENERAL PROVISIONS
9.1 Governing Law & Jurisdiction
9.1.1 This Policy is governed by the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising under this Policy, subject to non-excludable statutory rights in your jurisdiction as described in Section 4.
9.1.2 This Policy must be read together with the Smarternuthub Terms of Service. In the event of any inconsistency, the Terms of Service prevail.
9.2 Entire Agreement
This Policy, together with the Smarternuthub Terms of Service and Privacy Policy, constitutes the entire agreement between you and Smarternuthub with respect to refunds, cancellations, and financial commitments. No verbal representation, social media post, marketing material, or informal communication creates any additional right or obligation.
9.3 Severability
If any provision of this Policy is found invalid, void, or unenforceable, it shall be modified to the minimum extent necessary, and all remaining provisions continue in full force and effect.
9.4 Price Amendments & Notice to Existing Subscribers
9.4.1 Smarternuthub reserves the right to update the Standard Monthly Rate, Annual Monthly Rate, App Subscription Rate, and eBook Rate at any time by updating the Pricing Page. The price displayed on the Pricing Page at the time of your purchase or activation is Your Confirmed Rate and governs that specific transaction.
9.4.2 For existing month-to-month Membership and App subscribers: where Smarternuthub intends to increase the fee applicable to your ongoing subscription, not less than thirty (30) days' written notice will be provided to your registered email address before the increased rate takes effect on your next renewal. Continued use after the notice period constitutes unconditional acceptance of the new rate.
9.4.3 For Annual Commitment Plan subscribers: the Annual Monthly Rate is fixed at Your Confirmed Rate for the full Commitment Period and will not increase during that period. The post-commitment auto-renewal rate is the Standard Monthly Rate then published on the Pricing Page, subject to Section 3.2.5.
9.4.4 It is your responsibility to maintain a current and accessible email address on your account. Smarternuthub is not liable for failure to receive a price change notification where notice was sent to your registered email address.
9.5 No Waiver
Smarternuthub's failure to enforce any provision of this Policy on any occasion does not constitute a waiver of that provision or of Smarternuthub's right to enforce it on any future occasion.
9.6 Relationship to Terms of Service
This Policy forms part of the Smarternuthub Terms of Service. Capitalised terms used but not defined in this Policy have the meaning given in the Terms of Service. Where both documents address the same matter, they are to be read consistently, with the Terms of Service prevailing in any conflict.
ACKNOWLEDGEMENT OF POLICY
By completing any purchase, activating any free trial, downloading any Digital Product, or subscribing to any Smarternuthub service, you irrevocably acknowledge that:
(a) you have read this Policy in its entirety prior to purchase;
(b) you have reviewed Your Confirmed Rate on the Pricing Page and in your purchase confirmation email, and agree those figures are binding;
(c) you understand and agree to be legally bound by every provision of this Policy;
(d) you are of legal age in your jurisdiction to enter into a binding contract;
(e) you have had the opportunity to seek independent legal or consumer advice before purchasing; and
(f) your acceptance is voluntary, informed, and not the result of any misrepresentation.
